Report: Man charged after using pepper spray on motorcyclist
DALTON, Ga. — A man who called Whitfield County 911 to report a yellow sports bike following the car he was riding in was arrested on Friday and charged with aggravated assault after the man on the sports bike told a deputy the man pepper sprayed him, according to an incident report.
Dillon Ray Owens, 24, of 740 North Drive S.E. in Dalton, was charged Friday by the Whitfield County Sheriff’s Office. The aggravated assault charge stems from the incident at the intersection of Chatsworth Highway and the north bypass on May 31. Owens was released from jail on Friday after posting a $5,000 bond.
“My attorney will tell my side in court,” Owens said when reached by phone, declining to give his attorney’s name. “I know I will never try to help someone again.”
According to the incident report from the sheriff’s office, Owens called 911 and the 911 center issued a lookout for the yellow sports bike that was said to be following a black Volkswagen Jetta on the bypass. The 911 center then received a call from the driver of the sports bike. A deputy met with the man and his wife, who had been following the man on the sports bike in a truck.
The wife said she stopped at the traffic light at the intersection of Chatsworth Highway and the bypass and a black car pulled next to her. She said a white male got out of the car and “started to yell” at her. She could not understand what he was saying. She said her husband pulled next to the black car on his sports bike to ask why the man was yelling at her.
The wife stated “the occupants of the black car could have been mad at her because she cut upfront of their car” because she wanted to know why the man was yelling at her.
The husband said he saw a while male get out of the Jetta and yell at his wife. He said “when he approached the male to ask what was going on the male (pepper) sprayed him.” He followed the Jetta on the bypass to get the license tag number.
The 911 center tried to get Owens to stop at the sheriff’s office, according to the report, but the Jetta did not stop.
A witness, who said he saw the use of the pepper spray, said the Jetta almost struck him when it ran a red light.
The driver of the sports bike identified Owens as the person who pepper sprayed him when deputies showed the driver a photo of Owens. The wife said she was not sure if the photo was of the offender “because the offender was clean shaved and the person in the photo had facial hair.”
The deputy sought warrants for Owens for “willfully spraying a chemical substance onto (the man’s) face that is designed to cause an intense burning sensation to the affected areas and when applied to the face can cause the eyes to slam shut causing temporary blindness,” the report said.
